GENERAL TERMS & CONDITIONS

TERMS & CONDITIONS OF SERVICE IN WOOLWORTHS & Virgin Active  

 

  • At The Fox Box takes no responsibility for any medical problems uncovered during the beauty treatment all possible medical complications should be made known to us before the treatment.

  • All soak off treatments including "File and Paint" refer to the PP polish preferences and hand/manicures only treatments only. These prices do not refer to pedicure of feet treatments. 

  • At The Fox Box courtesy and respect is expected from all parties therefore reserves the right to refuse a customer.

  • All clients are requested to complete and sign a detailed client record card in compliance. This helps The Fox Box to provide a tailored service to you. Changes in your details are your responsibility to inform me. Data is confidential and will not be passed onto any 3rd party.

  • Whilst you are at The Fox Box care your health and safety is our primary concern. Although extremely unlikely, accidents can occur during the beauty treatment and in the event of an emergency we will seek emergency medical treatment.

  • After each session we will provide detailed feedback. If you have any queries or need further advice The Fox Box will be happy to do this. If you are dissatisfied with any aspect of your treatment please let us know before leaving. Reasonable requests to alter the treatment will be dealt with immediately or changes noted for future treatment.

  • If any gel supplied during the treatment lifts or chips within four days of application we will fix the nail to which the polish has been applied. Nail enhancements is only guaranteed for seven days within which time period we will fix any faulty enhancements. Additional service pertaining to faulty polish or enhancements will only be undertaken on receipt of a proof of payment.

  • All beauty treatment costs are payable in full upon finalisation. Please refer to Price list for more details.

  • Please be punctual, we work by appointment only, on a one-to-one basis. Most sessions last between 20 – 30 minutes. In the event of a client being 10 minutes or longer late for a treatment appointment the appointment will be cancelled and the full deposit paid in instance if applicable will be forfeited by you.

Tinting Disclaimer:

 

Although we use every precaution to ensure your safety and well-being before, during and after your tinting application, please be aware of the possible risks below. Utilizing our services you acknowledge and accept the below associated risks:

 

  • Tinting lashes or brows has some inherent risk of irritation to the orbital eye area, including the eye itself, and could result in stinging or burning, blurry vision and potentially blindness should the tint enter into the eye.

  • You may have a patch test at least 24 hours before your appointment if you wish, please ask our Foxer about this. 

  • If at any time, you are uncomfortable with the treatment, you will inform the technician and they will gladly rectify the problem, including ending the session. 

  • If the tinting agent, developer, or mixture of both accidentally comes into contact with your eye, your eye will be flushed with water but medical attention may be required.

  • Some irritation, itching or burning may occur to the skin which comes in contact with the tinting agent.

  • There may be some residual dark staining left on the skin following the tinting process of either my lashes, brows or both. This will fade and go away within a short time.

  • While every attempt will be made to provide me with my chosen color, everyone’s hair absorbs color differently and my final results may not be the color I initially wanted.

  • Because RESULTS VARY and are NOT GAURANTEED, I understand that a refund will not be issued if results are not desired. If for any reason there is an issue that was caused on the technician’s behalf, you understand you have 3 days from the original appointment date to schedule another appointment to fix any issues, which will be free of charge. 

  • You understand there are no guarantees for the length of time my eyelash and/or eyebrow tint will last.

  • Over the course of several weeks, the tint will gradually lighten and fade. Re-tinting will be required to keep the new color fresh. 

  • If you attend your appointment with make up, oil and product residue our Foxers will remove but we cannot gaurantee a satisfactory result.

Threading Disclaimer

 

  • Threading can have certain side effects such as skin removal, redness and tenderness.

  • You understand that even though the technician will use the proper techniques, the instruments, tapes, cleansers, adhesives, removers, tints, eyelash lift and other products used may irritate my eyes or require further follow-up care. 

 

Lash Lift Disclaimer

  • You understand that even though the technician will use the proper techniques, the instruments, tapes, cleansers, adhesives, removers, tints, waxes eyelash lift and other products used may irritate my eyes or require further follow-up care.

 

  • You understand that in order to have the procedure performed you will need to keep my eyes closed for a duration of 30-180 minutes during the procedure. 

 

  • You also understand that you will need to be lying in a reclined position. Any medical conditions that might be aggravated by lying still for a prolonged period of time may mean you will not be able to have the procedure performed on my eyes and/or eyebrows. 

 

 

Lash Extension Disclaimer

 

  • Eyelash extensions will be applied to the natural lash as determined by the technician so as not to create excessive weight on the natural eyelash thereby preserving the health, growth and natural look of my natural eyelashes. 

 

  • You understand that in order to have the procedure performed you will need to keep my eyes closed for a duration of 30-180 minutes during the procedure. 

 

  • You also understand that you will need to be lying in a reclined position. Any medical conditions that might be aggravated by lying still for a prolonged period of time may mean you will not be able to have the procedure performed on my eyes and/or eyebrows. 

 

  • You understand this procedure requires individual synthetic/non-synthetic eyelashes to be glued to my own natural lashes. You understand it is your responsibility to remain still during the application and to keep my eyes closed during the entire process until otherwise advised.

 

  • You acknowledge that our Foxer has explained to you the methods and procedures concerning the application of semi-permanent eyelash extension application and that there are certain complications and risks inherent both in the application process and in wearing semi-permanent lashes.  These risks may include, but are not limited to, temporary eyelash loss as the result of improper post application care, transient eye redness and irritation, and or an allergic reaction to the adhesive, under eye gel patches and or other products used during the procedure

  • We require a deposit of 80% to confirm any mobile service. We may impose a cancellation fee in the event of cancellation before event date. The fee will depend on the nature of the event, the length of notice of cancellation before the event, the reasonable potential to find alternative clients and the reason for cancellation. There will be no refund of the deposit if the event is cancelled within less than 48 hours notice. 

  • In the event of a strike, protest or some other form of action which will disrupt public transport and road access we will do our utmost best to keep the booked time but reserve the right to notify the client of any late comings. 

  • Cancellations must be made more than 24 hours before your appointment. Failure to do so will incur a cancellation fee of 50% of your treatment cost will apply.

  • Missed appointments will incur a cancellation cost of 80% of the invoice cost. This will not be reimbursed. 

  • We ideally require 48 hours notice to secure your pampering. 

  • We require proof of payment of your deposit 48 hours before your pampering to arrange your team for the request. Without POP we cannot confirm you appointment only availability. 

  • We do not guarantee we can facilitate your booking request. 

  • Payment of the deposit is deemed as acceptance of our terms & conditions

TERMS & CONDITIONS OF SALE OF BEAUTY PRODUCTS

 

Cancelation Policy

We require a deposit of 50% to confirm the order for the beauty products to be provided. We may impose a cancellation fee in the event of cancellation before delivery. The fee will depend on the nature of the order, the length of notice of cancellation before delivery, the reasonable potential to find alternative clients for the order and the reason for cancellation. No refunds on deposits in the event of cancellation for already ordered/made Special–Order Goods.

 

Refund Policy

Please choose carefully. The Fox Box does not normally give refunds if you simply change your mind or make the wrong decision with regard to the beauty products being purchased. You can choose between a refund or exchange where the health or skin care products is proven as defective within the warranty period or within 10 business days the products are wrongly described, different from the sample shown to you or do not perform. If the beauty products are altered or amended we will not accept a return of the beauty products, unless defective. We may charge a handling fee if the return is accepted by management.

 

Delivery

Whilst times for the availability of the beauty products on order are given in good faith and The Fox Box will use every endeavour to comply therewith, no responsibility can be accepted for any loss or damage incurred by the Client on account of any delay in timeously supply of such beauty products arising out of any circumstances beyond The Fox Box control, which circumstances will include, but in no way be limited to:

  • Any delays in the supply of beauty products by The Fox Box Suppliers which cannot be directly or indirectly attributed to them;

  • Any delays due to freight services;

  • The client not providing The Fox Box with necessary information in order to determine the specifications of the beauty products to be provided;

  • If the balance of the contract price payable on date of reservation is not paid on date that the beauty products are to be available.

  • The Fox Box will communicate unavoidable delay in the delivery.

 

Warranty

The Fox Box warrants its customers that the beauty products which have been supplied by the Company and delivered to the Customer shall be free from defects and subject to the following:

 

The warranty is effective for a period of six months or the best before date whichever occurs first. The date is determined from date of delivery and will the Customer be entitled to either request a refund; replacement or repair of goods if goods are defective within such period;

 

The Fox Box shall not be liable or responsible in any way for any damages of whatsoever nature, including consequential and penal damages, caused by or due to any failure of operation or malfunction of the beauty products, unless such damages can be attributed to any circumstances reasonably within the control of The Fox Box;

 

The warranty shall immediately be rendered null and void in the event of any of the following:

  • Any alterations or modifications made to the beauty products supplied, without the prior consent of The Fox Box;

  • Failure to use beauty products in accordance with the instructions and specifications of The Fox Box for instance using it after the best before date;

  • General miss use and abuse of goods by the Client;

  • Any damage caused by fire, flood, civil disturbance or act of God;

  • The beauty products supplied have not been inspected by a technical expert in order to evaluate/determine the reason for the defects in the beauty products, before the client requested its replacement, repair or refund.

 

Indemnity

I, the undersigned, acknowledges the risk involved in the supplying of beauty products by The Fox Box and hereby indemnify the supplier against claims for harm/damage cause to me/ due to reasons beyond the reasonable control or unintentional act of any person, whether or not in the employ of the supplier. This will any economical lost pertaining to the harm/damage caused.

 

Payment Terms

The Fox Box reserves their right to suspend delivery of any orders in the event that payment for such orders is not made on time. In the circumstances where payment is outstanding for a period exceeding 30 days from date of statement The Fox Box will charge interest at a rate not exceeding 2% per month or as per the maximum rate determined by the National Credit Act from time to time on overdue payments.

 

All accounts older than 30 days will be handed over for collection and will the Customer be liable to pay all legal fees with regard to the collection of such outstanding amounts on a fees scale as determined by the court of law/tribunal where the collection matter will be adjudicated.

 

The Customer hereby agrees to the jurisdiction of the Magistrate Court of in the event that any outstanding amount is handed over for collection, although such Magistrate Court may normally not have jurisdiction in the matter.

TERMS & CONDITIONS OF VOUCHERS

  • The voucher can only be exchanged for a treatment/s to the stated value of the voucher at the Fox Box.

  • No credit will be given should the recipient wish to redeem the voucher for a treatment of a lesser value.

  • This voucher can only be redeemed within the relevant FoxBox division as stated on the voucher (i.e. FoxBox Express Nail Den within Select Woolworths stores or FoxBox mobile division.)

  • Should the recipient upgrade the treatment of the voucher (i.e. selecting to have a gelish treatment instead of the PP treatment as stated on the voucher) the recipient will have to pay in the difference.

  • Vouchers cannot be exchanged for cash.

  • The Treatments are subject to price increases annually and the recipient will have to pay in any price difference if there was a price increase during the 3 years period the voucher is valid for.

  • The voucher can only be redeemed by the recipient the voucher was issued for.

  • The Fox Box will not be liable in the event of the voucher being lost, damaged or stolen.

  • No treatment/s can be performed without presenting this voucher on date of the appointment.

  • This voucher is valid for 3 years from date of issue.

  • Clients may redeem only one Home Visit Discount Voucher per person per visit

  • The Minimum spend is R350 per person before the deduction of the home visit voucher

  • Should there be a group of people each redeeming their own home visit discount voucher the total spend per person must be minimum of R350 each. If it is less the number of vouchers redeemable will be calculated based on the total spend for the group.

Terms and conditions of specials

  • The special is only valid within the advertised FoxBox division (i.e. Woolworths Express Nail Dens, Virgin Active Silo's District Collection Club or Mobile Division)

  • The special is only valid for redemption within the advertised period and may not be redeemed once the special has come to an end

  • The special may not be exchanged for anything other than what is being advertised

  • Specials are created at the discretion of The FoxBox 

  • Specials are subject to availability during their advertised period.
